Your draft

This is a draft to take to a lawyer, not a legal document. A will is only valid if it meets your local law, including witnesses and signing.

Guide

Why every Muslim needs a will, especially in the West.

The Prophet ﷺ said: "It is not right for a Muslim who has something to bequeath to spend two nights without having his will written with him."1 In the US, the UK and Canada this matters even more, because without a valid will the local intestacy law divides your estate, and it does not follow the shares Allah set.

What an Islamic will contains

  1. A declaration of faith and a reminder to your family to keep to Islam.
  2. Debts first, including any unpaid mahr, zakat or kaffarah.
  3. A bequest (wasiyyah) of up to one third, to people who are not your heirs or to charity.2
  4. The rest by the Islamic shares, worked out at the time of death.
  5. Funeral wishes according to the Sunnah.
  6. An executor and guardians for minor children.
Hanafi position

A bequest is valid up to one third of the estate after debts. More than one third, or any bequest to an heir, only takes effect if the adult heirs agree after the death.3

Other madhhabs
Shafi'i, Maliki, Hanbali
The same in principle: one third at most, and nothing to an heir without the other heirs' consent.

Making it legally valid

  • United States: rules differ by state. Most require signing in front of two witnesses who are not beneficiaries, and a self-proving affidavit with a notary helps.
  • England and Wales: sign in front of two independent witnesses who also sign. Remember that marriage revokes an earlier will.
  • Canada: rules differ by province. Most require two witnesses, and some provinces accept a handwritten (holograph) will.

Have a lawyer who understands Islamic wills check the final version, so it is both valid and Islamic.

  1. Sahih al-Bukhari 2738; Sahih Muslim 1627.
  2. Sahih al-Bukhari 2742.
  3. Sunan Abi Dawud 2870; al-Marghinani, al-Hidayah, Kitab al-Wasaya. The other madhhabs' positions are summarised from their standard manuals.

Questions

Good to know.

Is a will obligatory in Islam?

Writing down debts and trusts is obligatory. A bequest to charity or non-heirs is recommended. In the West, a will is also the only way to make the Islamic shares legally binding.

Can I leave money to my wife or children in a will?

Not as a bequest, because they are already heirs. Their shares come from the Islamic division of the rest of the estate.

Can a non-Muslim relative receive a bequest?

Yes. A non-Muslim does not inherit from a Muslim, but may receive a bequest within the one third.

Is this will legally binding?

Not on its own. It is a draft. Have it signed and witnessed under your local law, ideally with a lawyer's help.
