Short answer
Yes. In the Hanafi school a clearly written talaq counts just like a spoken one, so a text, WhatsApp message or email from the husband saying "I divorce you" takes effect, even if he later says he did not mean it. Unclear wording needs intention. If someone else sent it without his knowledge, it does not count.
Written talaq is valid when the writing is clear and addressed to the wife (kitabah mustabinah marsumah): it takes effect without asking about intention. Writing that is clear but not addressed, such as notes to himself, needs intention. A message sent from his phone by someone else, without his order, does not count.
Other madhhabs
- Shafi'i
- Written talaq is treated as an indirect expression (kinayah), so it counts only if the husband intended divorce.
Explanation
The Hanafi jurists discussed divorce by letter centuries ago, and a text message is the same in principle: written words that last and can be read. If the husband types and sends, "I divorce you," or "I give you talaq," the talaq takes effect when he sends it, whether she reads it then or later. The iddah starts from the time of the talaq, not from when she reads it.
Common situations:
- "I was only joking" or "I was testing her". Clear talaq counts even in jest. See the hadith in talaq in anger.
- Unclear words, such as "we are done" or "go to your parents' house for good." These are kinayah (indirect) and count only if he meant divorce.
- Someone else sent it from his phone without his order. It does not count, but if he later approves it, scholars differ, so ask.
- Typed but not sent, or written in a draft. Generally not addressed, so it depends on his intention.
- Three in one message, such as "talaq talaq talaq." Read three talaq at once.
Talaq by text is valid but far from the sunnah. It is cold, it humiliates, and it often comes from a moment of anger. If you are a husband thinking of it, stop and follow the divorce process instead. If you have sent or received such a message, save it and ask a mufti what exactly happened.
Ask a mufti about your own case. This answer explains the general ruling. When the details of your situation matter, as they do here, ask a qualified mufti and give them the full facts. Where to ask a scholar.
The evidence
Quran, Surah Al-Baqara 2:231
And when you divorce women and they have [nearly] fulfilled their term, either retain them according to acceptable terms or release them according to acceptable terms, and do not keep them, intending harm, to transgress [against them]. And whoever does that has certainly wronged himself. And do not take the verses of Allah in jest. And remember the favor of Allah upon you and what has been revealed to you of the Book and wisdom by which He instructs you. And fear Allah and know that Allah is Knowing of all things.
Words of talaq have real effect and are not to be treated lightly.
Quran, Surah Al-Baqara 2:229
Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah. But if you fear that they will not keep [within] the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah - it is those who are the wrongdoers.
Even a divorce should be given with dignity, not by careless messages.
Sunan Abi Dawud 2194
Graded hasan...
"Three things are serious when meant seriously and serious when said in jest: nikah, talaq and taking back."
A clear talaq takes effect even if he says he was not serious.
Where the ruling is recorded
- Radd al-Muhtar (Ibn Abidin), Kitab al-Talaq, on talaq by writing. Clear, addressed writing counts like speech; unaddressed writing needs intention.
- al-Fatawa al-Hindiyya, Kitab al-Talaq, chapter on talaq by writing. Details of written divorce and when it takes effect.
- al-Majmu' (Nawawi), Kitab al-Talaq, on written divorce. The Shafi'i view that writing needs intention.
