Short answer
Yes, in the Hanafi school saying Allah's name at slaughter is a condition. If the slaughterer leaves it out on purpose, the meat is haram; if he simply forgets, the meat is halal. The Maliki and Hanbali schools agree, while the Shafi'i school treats it as a sunnah.
The tasmiyah is a condition of valid slaughter for a Muslim or Kitabi who remembers it. It must be said by the slaughterer himself, at the time of the cut, over each animal. Deliberate omission makes the meat haram; forgetting is excused.
Other madhhabs
- Shafi'i
- Saying bismillah is a sunnah. Meat is halal even if it was left out on purpose, though leaving it out is disliked.
Explanation
The usual words are Bismillah, Allahu akbar (in the name of Allah, Allah is the greatest). Any words that mention Allah alone are enough, in any language. Saying only Allahu akbar also counts, since it mentions Allah.
Three details matter in the Hanafi school:
- Who says it: the person making the cut. Someone standing nearby saying it on his behalf does not count.
- When: just before or with the cut. If he says it, then talks at length or eats before cutting, he repeats it.
- How often: once for each animal. If he lays two animals side by side and cuts both in one stroke, one bismillah covers both.
Forgetting is forgiven. If a Muslim slaughterer forgot the tasmiyah, his slaughter is still valid, and the meat is halal. But a habit of leaving it out, or a system built without it, is a different matter, which is why machine slaughter is rejected in the Hanafi fatwa position (see machine slaughtered chicken).
Saying bismillah at the table is a separate sunnah (see the dua before eating). It does not make up for a missing tasmiyah at slaughter. The hadith of Aisha about meat whose slaughter was unknown was about meat brought by Muslims new to Islam: their slaughter was presumed valid, and the Prophet ﷺ told the Companions not to dig into it but to say bismillah and eat.
The evidence
Quran, Surah Al-An'aam 6:121
And do not eat of that upon which the name of Allah has not been mentioned, for indeed, it is grave disobedience. And indeed do the devils inspire their allies [among men] to dispute with you. And if you were to obey them, indeed, you would be associators [of others with Him].
The Hanafi proof that the tasmiyah is a condition.
Quran, Surah Al-Baqara 2:286
Allah does not charge a soul except [with that within] its capacity. It will have [the consequence of] what [good] it has gained, and it will bear [the consequence of] what [evil] it has earned. "Our Lord, do not impose blame upon us if we have forgotten or erred. Our Lord, and lay not upon us a burden like that which You laid upon those before us. Our Lord, and burden us not with that which we have no ability to bear. And pardon us; and forgive us; and have mercy upon us. You are our protector, so give us victory over the disbelieving people."
The basis for excusing the slaughterer who forgets.
Sahih al-Bukhari 5503
Sahih...
"Whatever makes the blood flow and has Allah's name mentioned over it, eat it."
Names the mention of Allah as part of what makes meat lawful.
Sahih al-Bukhari 5507
Sahih...
"Say Allah's name over it yourselves and eat it."
Said about meat from Muslims new to Islam: their slaughter was presumed valid, and saying bismillah at eating is a sunnah, not a replacement for the tasmiyah.
Where the ruling is recorded
- al-Hidaya, Kitab al-Dhaba'ih. Tasmiyah is a condition; deliberate omission makes the animal haram, forgetting does not.
- al-Majmu' (Nawawi), Kitab al-Sayd wa al-Dhaba'ih. The Shafi'i view that the tasmiyah is a sunnah.
